This Privacy Statement explains the processing of personal data on windpower-app.com and when using the WindPower app. The website and the installed app have different functions and therefore process different data.

The following information about app functions applies to the extent that the respective function is offered and used by you on your platform and app version. If you have any privacy concerns, you can contact us using the contact details mentioned above.
Website and hosting
When visiting this website: We don't have any ad tracers or analytics tools of our own. Images, movies, fonts and the data of the globe view are loaded from the website server. The global view uses aggregated plant locations, not your location.
Technical provision
When the website is accessed, technically necessary connection data is processed. This includes, in particular, your IP address, the time and destination of the request, the amount of data transmitted, the status of the response, and browser and operating system information. As long as your browser transmits it, the previously visited page may also be included. This data is processed for delivery, error analysis and supply protection purposes and can be recorded in server logs.
The website is hosted by Hostinger. The following information is provided by the Commission to the European Parliament and to the Council: Hostinger processes hosting data as an order processor. Information on the contractual data protection rules and the subcontractors used is provided by Hostinger in Data processing addendum I'm ready to go.
The legal basis for the technical provision and safeguarding is Art. 6 (1) f DSGVO. Our legitimate interest lies in a functional and secure Internet service. Technically necessary storage and access operations on your device are governed by Art. 25 (2) TDDDG. Consentful cookies or comparable analytics storage are not used by this website itself.
Movies and external links
The campaign videos are delivered directly from our website server. When you play them, no external video player from YouTube or any comparable provider is loaded. By clicking on a store or other external link, you leave our offer. The services that are then called on are subject to the data protection information of their respective operator.
Contact by e-mail or telephone
When you contact us, we process the information you provide, such as your name, email address, phone number, and message content, to process your request. The website does not contain a contact form; an email link opens your own email program.
If your request concerns a contract or its conclusion, the processing is carried out on the basis of Article 6 (1) (b) GDPR. Other requests are processed on the basis of Article 6 (1) (f) GDPR; our interest is the proper response to the incoming communication. Legal retention obligations are governed by Article 6 (1) (c) GDPR.
App: local data and online features
The app stores asset data on your device. Settings, favorites and most recently-viewed devices can also be stored locally. This enables the functions requested by you and is governed by Art. 6 (1) (b) DSGVO and, where access to your device is required, Art. 25 (2) No 2 TDDDG.
Maps, weather, location search, news and data updates require Internet connections. In such connections, the respective server technically receives your IP address and the information required for the request. Updates of plant data can be made, among other things, via windpower-business.com; further app requests are processed through our services under rainbow-learning-software.com.
Local storage of app content therefore does not mean that all app functions work without data transmission. The individual processes are explained below.
Location, maps, search and weather
For functions near you, the app can use the location of the device if authorized through the operating system. Depending on the authorization and device, this can be accurate or approximate. You can change or withdraw the location permissions in the system settings. Without authorisation, device location-related functions may not be available; you can choose facilities or locations independently.
When searching for a location, the coordinates of the selected or current location can be transmitted to our servers. Weather queries contain the coordinates of the requested location of the installation. Such coordinates are not automatically your actual location.
The map and search functions use the services of Google Maps and Google Places. In particular, IP address, technical app and device information, search terms, language, and requested map areas and, where applicable, location data may be transmitted to Google. When you start a navigation, the location information you need will be transmitted to the navigation service you have opened.
The processing required by us for the requested map, search or weather function is based on Art. 6 (1) (b) GDPR. Where a separate consent is required, it is in accordance with Art. 6 (1) (a) GDPR and Art. 25 (1) TDDDG. An operating system authorisation concerns access to the device and does not replace any further data protection consent required.

Photographs, documentation and LMRA
For image documentation, you select photos on your device and, if necessary, add your own text. LMRA documents may contain activity information, names, ratings, and signatures. This content is processed to create and store your documents. Photo and generated PDF files are not automatically uploaded to us by these functions. The response selection in LMRA checklists can be transferred as a usage event in active app statistics, as described in the section on usage statistics.
You choose the storage location or the recipient of an export yourself. If you're using a cloud storage, a backup feature, an email program, or another app to store or share, this service can retrieve the files. In this case, its own data protection conditions are also relevant.
The legal basis for the documentation you request is Art. 6 (1) (b) DSGVO. Required access to equipment is governed by Art. 25 (2) No 2 TDDDG. Select only the data you are allowed to use and when using it for your professional purposes, take into account the specifications of your employer and the rights of the persons depicted or named.
App stores and subscriptions
Downloads, subscriptions and payments are made through the Apple App Store or Google Play. The platform processes, among other things, store account information and payment information on its own terms. We do not have full access to your payment information through these services.
The app processes the purchase or subscription status and the product and transaction information provided for the purpose of verifying and administering the rights of use. This may include platform-specific purchase notices, certificates or tokens. The legal basis for the necessary verification of authorisation is Article 6 (1) (b) GDPR.

App usage statistics
In app versions with activated usage statistics, usage events are transmitted to our servers at rainbow-learning-software.com to evaluate the use of features and improve the app. The app uses an installation identifier stored on the device. It can be used to assign multiple events to the same installation.
The information transmitted may include installation identification, timing, app and operating system version, subscription status and information on the functionality used. Event information may also include the selection of responses in LMRA checklists, the title of a message called and the content of a feedback sent. In addition, the IP address is also relevant for the transmission.
These data are not anonymous just because no name is given. A recognisable installation identification enables an assignment and is treated as a pseudonymous date. App statistics must be distinguished from technical access data on this website.
An analysis of use requiring consent requires consent under Art. 6 (1) (a) GDPR and for corresponding storage or access operations under Art. 25 (1) TDDDG. The mere reading of this declaration and the acceptance of the GTC does not constitute such an acceptance. The Android implementation currently tested does not have a separate consent or withdrawal counter for usage statistics. A contact with us will not automatically shut off the transmission on your device. The statistical events transmitted are stored permanently in a MySQL database. Automatic deletion or anonymisation is not currently envisaged. The receiving server also enters the transmitted data into the PHP error log. This additional protocol does not specify a specific deletion period.
Feedback
When you send feedback through the app, we receive the content you enter and the technical information you provide for processing. If the usage statistics are active, the sending can also be recorded as an event with feedback content, as described in the previous section.
The processing of any contractual feedback you request is based on Art. 6 (1) (b) GDPR. For the processing of other feedback and error reports, we rely on Art. 6 (1) (f) GDPR. Our legitimate interest is to process your feedback and correct errors in the app. A separate analysis of this is addressed in the section on usage statistics.
News and translations
The app can retrieve messages from external sources, including North American Windpower, offshoreWIND.biz, Windkraft-Journal, and CleanTechnica. When directing, the respective provider receives technically necessary connection data, in particular the IP address. Opening an article leads to an offer from the respective publisher.
For translations, newsletters or headings and the desired language can be sent to our translation service and, where appropriate, to a Google translation service. The provision of a requested message or translation function by us is based on Article 6 (1) (b) GDPR. The recording of calls in the app statistics is described in the section on usage statistics.
Recipients and international processing
Data shall be communicated to service providers where necessary for the purposes described, in particular to hosting and communication service providers and to the card, search, news and store providers used in each case. Processors shall be employed on the basis of the contractual arrangements provided for therein. Such communication may also be necessary to fulfil legal obligations or to assert, exercise or defend legal claims.
For international providers, in particular Hostinger, Google and Apple, processing may take place outside the EU or the European Economic Area. For such transfers, the requirements of Article 44 et seq. of the GDPR are essential. The guarantees include in particular a relevant adequacy decision or standard contractual clauses with the necessary additional safeguards. You can find information on the basic and protective measures used by the respective provider in the data protection or contractual information linked above. You can request information about the safeguards applicable to our processing.
Duration of storage and deletion
For app usage statistics, the permanent storage without automatic deletion described in the previous section applies. For other processing, the storage criteria are based in particular on the duration of processing of your request, existing contractual and verification obligations and the need to clarify specific violations or security incidents. Data subject to a statutory retention obligation will be restricted for other purposes and deleted after the relevant deadline.
Local app data can be managed using the functions or system settings offered. When deleting app data, settings and locally stored content can be lost. Exported files and copies to selected storage or backup services are independent of this and must be managed separately. A deinstallation does not remove any data that has already been transferred to servers and does not cancel a store subscription.
You can request information or deletion of personal data at the contact address mentioned above. If data can only be assigned via an installation identifier, appropriate assignment information may be required for processing. Please do not provide passwords or payment data.
Your data protection rights
Under the relevant legal requirements, you have the right to information (Article 15 GDPR), rectification (Article 16), deletion (Article 17), restriction of processing (Article 18) and data transferability (Article 20). You can revoke a consent granted at any time with effect for the future. The legality of the processing before the withdrawal shall be unaffected.
Objection: You may object to processing pursuant to Article 6 (1) (f) GDPR for reasons arising from your particular situation (Article 21 GDPR). We do not then process the data further unless there are legal requirements for continuation.
You have the right to complain to a data protection authority. For example, you can contact the authorities of your usual place of residence, workplace or place of suspected infringement. We do not use the data described here for an exclusively automated decision having legal or similarly significant effect within the meaning of Article 22 of the GDPR.
